SUBJECT:                 Sentence Appeal - Criminal Code of Canada, R.S.C. 1985, c. C-46, s. 830

 

SUMMARY:              The appellant was convicted and sentenced in summary proceedings for breaching the conditions of a recognizance contrary to s. 811(b) of the Code.

 

He appealed his sentence directly to the Nova Scotia Court of Appeal pursuant to s. 830 rather than appealing his sentence to the Supreme Court of Nova Scotia pursuant to s. 813.

 

RESULT:                   The appeal must be dismissed.  The Nova Scotia Court of Appeal does not have jurisdiction under s. 830 to hear an appeal from a sentence imposed in summary proceedings.
