SUMMARY: The worker sought leave to appeal a decision of theTribunal which found he was entitled to benefits pursuant to s.10E of the Act. The proposed grounds of appeal were that the Tribunal erred by delaying the hearing of his appeal pending amendments to the legislation, in not finding that s.10E was unconstitutional, in not allowing the appellant to make an oral presentation at the hearing of his appeal, and by misinterpreting s. 10E.
ISSUE: Should leave be granted?
RESULT: Application for leave dismissed.
