SUBJECT:           Sentence appeal - aggravated assault - s.268 Criminal Code

 

SUMMARY:         Offender sentences to 16 months incarceration followed by two years probation and a three year driving ban after intentionally driving his motor vehicle into victim.

 

ISSUES:               Did the sentencing judge err in principle by overemphasizing general deterrence resulting in a manifestly excessive sentence?

 

RESULT:              Appeal dismissed.  Sentence within the range for this crime and this offender.
