APPEAL HEARD:                                        April 7, 1997

 

JUDGMENT DELIVERED:              May 14, 1997

 

SUBJECT:           Criminal law - Narcotic Control Act.  Section 4(2).  Possession for the purpose of trafficking - Crown appeal against sentence - trial judge imposing conditional sentence of 14 months imprisonment to be followed by 12 months probation subject to conditions.

 

 

ISSUE:                 Whether sentence appropriate in case of drug trafficking.  Pre-sentence report favourable to conditional sentence.

 

 

RESULT:  In a split decision the Court of Appeal dismissed the Crown appeal                       against sentence.
