SUBJECT:                           Torts, Negligence, Causation: motor vehicle-pedestrian accident, apportionment of liability.

 

SUMMARY:                          Two pedestrians were killed and another was severely injured as a result of being hit by the cross-appellants motor vehicle. The trial judge apportioned liability 50% to the pedestrians, 20% to the appellant and 30% to the cross-appellant.

 

ISSUES:                                Whether the trial judge erred in fact or law, in finding the appellant and cross-appellant were negligent, in determining causation and in apportioning liability.

 

RESULT:                              Appeal and cross-appeal dismissed. There was sufficient evidence to support the findings of fact and conclusions of the trial judge. No error of law.
