Summary:   Mr. Turner sued the Attorney General of Canada alleging negligent supervision of Mr. Turner’s parole suspension by Correctional Services Canada (CSC). The Attorney General applied for summary judgment. The chambers judge granted summary judgment and dismissed Mr. Turner’s claim.

 

Issue: Did the chambers judge err in granting summary judgment to dismiss Mr. Turner’s claim?    

 

Result:        There was no evidence to support even an arguable case that CSC breached any standard of care, resulting in harm to Mr. Turner, respecting CSC’s handling of Mr. Turner’s suspension of parole. The Court of Appeal dismissed the appeal.
