SUMMARY:                          Appeal from trial judge's refusal to impose a conditional sentence.

 

ISSUE:                                  Whether the trial judge erred in imposing a sentence of 12 months incarceration for a carefully planned fraud.

 

RESULT:                              The Nova Scotia Court of Appeal held that the trial judge had considered all of the appropriate principles in imposing sentence, and that he had committed no error.  Leave to appeal was granted, but the appeal was dismissed.
