SUBJECT:       Young Offenders - Disposition - Robbery - Probation

 

SUMMARY:    The respondents, aged 16 and 17, pled guilty to charges of robbery of a sandwich shop and wearing a face mask. The trial judge imposed a sentence of 18 months probation with conditions including community service. On appeal, the Crown claimed that probationary dispositions for these offences were unfit.

 

ISSUE:             Were the dispositions fit?

 

RESULT:         Appeal dismissed. The dispositions could not be said to be demonstrably unfit or clearly inadequate. There was no error in principle which would warrant interference by the Court of Appeal.
