SUBJECT: Criminal law, storage of ammunition, regulations made under s. 116(1)(g) of the Criminal Code, s. 86(3)(a).
SUMMARY: Appellant appealed from a conviction under s. 86(3)(a) of the Criminal Code for unlawfully storing ammunition contrary to a regulation made under s. 116(1)(g). The Crown agreed with the appellant’s submissions that there was no such regulation relating to ammunition.
ISSUE: The Crown supported the appellant’s motion that the appeal be allowed and the conviction set aside.
RESULT: The appeal was allowed and the conviction that was ordered set aside.
