Reasons for judgment:

By the Court (Orally)

[1]             The panel has considered the written and oral submissions of counsel and reviewed the record. This is an appeal from an interlocutory decision and, therefore, requires leave of the Court.

[2]             The hearing judge, Justice Scott C. Norton, considered the applicable legal principles. He committed no error of law.

[3]             The decision to refuse the stay motion was an exercise of judicial discretion. The appellant has not demonstrated that the decision results in a patent injustice.

[4]             Leave is granted. The appeal is dismissed with costs payable forthwith by the appellant to the respondents in the amount of $1,000.
