NOVA SCOTIA COURT OF APPEAL
Citation: R. v. Ruddick, 2009 NSCA 126
Date: 20091209
Docket: CAC 305756
Registry: Halifax
Between:
Revere Ernest Ruddick
Appellant
v.
Her Majesty the Queen
Respondent
Judge: The Honourable Justice Nancy Bateman
Appeal Heard: December 4, 2009
Subject: Criminal Sentencing
Summary: The appellant entered guilty pleas to charges of aggravated assault; production of marihuana; and two counts of breach of an undertaking. The judge accepted a sentence of 7 years (before credit for remand time) jointly recommended by Federal and Provincial Crowns and defence counsel.
Issue: The offender, represented by new counsel on appeal, says the jointly recommended sentence is excessive.
Result: Looking at the collection of offences and given the particularly serious nature of this assault (the offender slashed the victim on both sides of his neck with broken glass and severed the tendons in one of the victim’s hands in a surprise attack from behind, some time after they had had words), the sentence was within the range taking into account the circumstances of the offender and the offence.
