SUMMARY:    In a personal injury action, documents sent by the plaintiffs’ counsel to an expert witness, and relied on by the expert, in preparation of a medical-legal report intended to be introduced at trial, were ordered to be disclosed to the defendant.

 

ISSUE:             Did the Chambers judge err in finding that litigation privilege had been waived?

 

RESULT:         Appeal dismissed. No reversible error.
