Summary: The Court varied an Order ExParte for child support retroactive to January 1, 2006, based on financial information put in evidence. The Payee made a subsequent Application to Vary.
Issue : On further Application to Vary, the Payee wanted the issue addressed about possibly having to repay child support because of the retroactivity of the Order.
Result: The Court further clarified the retroactive Order to be interpreted to mean it did not have the effect of eliminating arrears existing on October 30, 2006 nor did it operate to require the payee to repay child support either in the form of a credit or cash.
