Issue: Application to vary/reduce child support - undue hardship
Summary: This is an application to vary for a reduction in child support payments due to “undue hardship”. The parties were unrepresented and the court explained the criteria for undue hardship There was not evidence the Applicant came under the preliminary criteria required under s. 10 (2) of the Child Maintenance Guidelines. The court reviewed the Applicants’ income and found no significant or material change.
Result: The Court found no change in circumstances since the making of the previous order and no preliminary criteria for undue hardship and dismissed the application.
