Summary:             Securities Act R.S.N.S. 1989 - Certiorari - Jurisdiction - N.S. Securities Commission.

 

Issue:                  The Nova Scotia Securities Commission decided it had  original jurisdiction to determine whether a member of the Mutual Funds Dealers Association had contravened MFDA rules and by-laws.  The member appealed that decision to the Supreme Court.

 

Result:                Appeal in the nature of certiorari and the standard of review one of correctness, found that the Nova Scotia Securities Commission was correct in deciding it had original jurisdiction to decide the issue.
