Contempt – Penalty Stage

 

Penalty

 

  Incarceration is an available penalty for a contempt finding arising from disobedience of a maintenance order.

  Principles applicable to the penalty stage of a contempt proceeding reviewed.

A proportional penalty, designed to coerce compliance was granted given the egregious circumstances of the case. Imprisonment of four years, a fine of $384,000, and costs of $104,128.97.
