SUBJECT:                               Civil Law  - Claim of negligence against surgeon

 

SUMMARY:                             Plaintiff had surgery done by defendant. Extensive post-operative bleeding required additional surgical procedure to save plaintiff’s life.  Plaintiff claimed defendant was negligent in the way he conducted the first surgical procedure, how he explained risks of that surgery and how he obtained consent to second surgical procedure.

 

 

ISSUE:                         Had plaintiff proved negligence.

 

RESULT:                                  Action dismissed.  No evidence presented that treatment of plaintiff by defendant was negligent.  Post-operative problems not shown to be caused by defendant’s negligence.
