Summary:                  Ten year old boy has lived with mother since separation in 2003.  The parties have reached many agreements with regard to custody and access.  Access pursuant to these agreements has started but quickly stopped when the boy refuses to attend the access visits with his father.

 

Issue:                                                         Should there be a change in custody?

 

Result:                              Mother either intentionally or unintentionally causing the childs anxiety and fear of his father.  Sole custody to father, supervised access to mother after a transition period.
