The appellant was convicted of these offences:

1.              Dangerous driving (s.249(1) of the Criminal Code);

2.              Assault with a weapon (s.267(a) of the Criminal Code); and

3.              Failure to stop at an accident (s.252(1) of the Criminal Code).

In his appeal Mr. Rowlings primarily raised the issue of an improper R. v. W.(D.) analysis.

Did the summary conviction judge apply a proper R. v. W.(D.) analysis and/or misapprehend the evidence?

Result:

Dismissed the appeal on the basis that the trial judge properly applied R. v. W.(D.) and did not misapprehend the evidence.
