Subject:                Discharge of Bankrupt

 

Summary:             Bankrupt was granted a conditional discharge, suspended for two years, whereby he was required to pay a sum of money, representing money he should have reported and paid to his Trustee.

 

Issue:          The period of suspension having passed he asked the court to relieve him of the requirement of paying the money, as he was unable and would continue to be unable to pay it.

 


Result:                  Held the application was premature, but he was given the option of being discharged upon consenting to judgment for the amount.
