Issue:                            Interpretation of previous court order to determine which option the court would approve to effect the equal division of the pension held in the husband’s name.

 


Result:                          The pension administrator required both former spouses to agree as to the investment vehicle in which the wife’s share of the husband’s pension would be placed.  The former spouses were unable to reach agreement on the investment vehicle.   The court held that the wife as owner of her share, must have final decision making authority.  Costs of $1000 were assessed against the husband.
