Subject:                       Application for discharge of a bankrupt.                       

 

Summary:                   The bankrupt had financed her education with student loans.  She made an assignment in bankruptcy ten years after she had completed her studies.  The Attorney General of Canada objected to her discharge.

 

Issue:                          She had very little income.  She was separated from her husband and had two young children one of whom was autistic.  She had had limited opportunities to use her training as a teacher.  It was thought that it might be several years before she would be in a position to earn sufficient money to be able to make contributions to her estate.

 

Result:                        An absolute discharge was granted.
