Subject:                       The Court was asked for directions as to the proper action to be taken by a trustee when a bankrupt has not complied with the conditions for his discharge agreed upon with the trustee within the time limit of 21 months after the commencement of the bankruptcy, directed by the Superintendent’s Directive 12  - Terms of Discharge.

 

Result:                        The Court directed that agreement regarding terms of discharge must call for completion within the 21 month period, and that, if the terms are not completed within that time, the trustee has a duty to promptly refer the matter to the Court.
