Subject:                       The former husband sought costs as a result of successfully defending the former wife’s application to vary the custody and access provisions of the Corollary Relief Judgement that would have permitted her to relocate the parties’ children to Cape Breton.

 

Result:                        Costs awarded to the former husband in the sum of $30,000.00 inclusive of disbursements.  The former husband and his counsel were put to more pre-trial preparation than might normally be the case in applications such as this because of the numerous affidavits that he had to respond to including affidavit evidence from the former wife which included evidence of facts that pre-dated the previous order.
