Summary:                    The parents shared custody of the children for two years.  The mother seeks primary care of the children.   Both parties wanted to purchase the other’s interest in the matrimonial home.  Child support, both table and section 7, in issue.  The mother sought spousal support as she worked part-time during the 13-year marriage and the father was the primary earner. 

 

Issue:                          What is the appropriate custody arrangement, division of assets and support, both child and spousal?

 

Result:                        The shared custody arrangement to continue.  Equal division of assets and  debts.  The mother has 30 days to arrange to buy the father’s share in the matrimonial home, failing that the father has 30 days to buy the mother’s share.  If neither party is able to arrange to purchase the matrimonial home, it is to be sold and the net equity divided equally.  Child support in the set-off amount.  Spousal support in the amount of $1,000 a month.
