Facts:          Plaintiff claimed adverse possession of Defendant’s property.  On third day of trial, Plaintiff closed her case and tendered her exhibits.  Defendant’s Counsel made a non-suit motion.

 

Issue:          Whether there was evidence upon which a properly instructed jury could find for the Plaintiff.

 


Result:                  Non-suit motion granted.  Taken at its face value, the Plaintiff’s evidence was not sufficient to satisfy test set out in CPR 51.06.  In particular, the Plaintiff called no evidence from which a properly instructed jury could conclude that she and her predecessors had occupied the disputed property for a continuous 20 year period.
