LIBRARY HEADING
Judge: The Honourable Justice Beryl MacDonald
Heard: May 26, 2010 and June 2, 2010
in Halifax, Nova Scotia
Written Decision: June 8, 2010
Subject: Family Law, Maintenance and Custody Act, Interim Orders, Credibility, Custody/ Supervised Access, Domestic Violence
Summary: The parties had a tumultuous relationship while living together and after their separation with allegations of violence, drug use and poor parenting. Neither presented wholly reliable information but it was clear the Father had not been actively involved in joint decision making for the child who was primarily parented by the Mother. There had been no contact between the Father and the child for four months.
Issue: The custodial arrangement for the child and whether access with the Father was to be supervised.
Result: The Mother was to have sole custody. The Father was to have supervised access for a period of time and then proceed to unsupervised access for limited periods of time. The Father was not to be under the influence of non prescription drugs when exercising his access and he was to take a parenting course.
