Subject:                Sentence following conviction for second degree murder – determination of parole eligibility period.

 

Facts:          Jury found offender guilty of second degree murder.  Victim was 48 year old handicapped adult in his own home.  Murder particularly violent, brutal and unprovoked.  Motive was robbery.  Offender not on drugs or alcohol at time but motive was to get money to buy cocaine.  Offender on probation at the time of offence.

 

Result:                  Not eligible for parole until 20 years of life sentence served.
