This case was heard on the same day as Re Macumber, B 24136.  The fact situation is practically identical. 

 

For the reasons set out in Re Macumber it is ordered that:

 

1.                  The original certificate of discharge (conditions met) be set aside;

2.                  An Absolute Order of Discharge be granted by the court;

3.                  The trustee return to the bankrupt all monies received by the trustee from the bankrupt under the terms of the original conditional order issued by the trustee.
