Subject:       Application for the recovery of damages for 10% administration fee relating to the replacement of a culvert, damaged as a result of a motor vehicle accident where the respondent was liable.          

 

Summary:   The Province of Nova Scotia charged a 10% administrative fee of $66.94 for recovery of overheads relating to the cost to repair a damaged culvert.            

Issue: Did the amount sought to be recovered “arise naturally from the act complained of” and was the charge reasonable or arbitrary and artificial?         

 

Result:        The 10% administrative fee was reasonable and the respondent was ordered to pay the sum of $66.94.
