LIBRARY HEADING

Judge:             The Honourable Justice Mona M. Lynch

Heard:                        February 25, 2013 in Halifax, Nova Scotia

Subject:                      Family ‑ child support ‑ retroactive

Summary:                  Parties separated in 2002 and divorced in 2005.  CRJ required father to pay child support for two children based on income of $52,600.  Mother applied to vary in 2010 and father filed and provided documentation showing his income was $40,000 and threatened to apply for a reduction in child support.  Mother applied again in late 2011. Father filed a statement of income showing income of $52,000.  Closer to the hearing date, the father admitted to deceiving the mother and the court.  Father provided documentation showing income well above amount disclosed.

Issue:                          What is the father=s income? Is an order for retroactive child support appropriate?  If so, in what amount?

Result:                        Retroactive child support order of $171,786.00.
