Summary:

Applicant grandparents in Maintenance and Custody Act application sought an Order for Production for the psychological records of the Respondent in a Children and Family Services Act proceeding for the purpose of determining access.

 

 

Result:

Court ruled that only the portions of the report that was relevant to the child’s needs and the ability of the parties to meet those needs were to be produced.  The prejudicial effect and the privacy interests of the mother far outweigh any probative value of the remainder of the report.
