Summary:

The Applicants submitted a maximum of $5,000. plus disbursements would be an appropriate cost award and that the Respondents’ claim for solicitor client costs was not appropriate in the circumstances.

The Respondents claimed their actual legal expenses of $25,300. plus disbursements of $911.71 for a total of $26,211.71.

 

Result:

Court found there was an abuse of the Court’s process, due to inaction on the Applicant in carrying through with the Application.  Court found a just cost award in these circumstances to be $15,500. plus $2,000. previously awarded for a total of $17,500. plus disbursements.

The amount payable in costs to the Respondents shall be $17,500.00 plus disbursements of $911.71 for a total of $18,411.71.
