LIBRARY HEADING

Judge:                         The Honourable Justice N. M. Scaravelli

Heard:                        August 21, 2013 in Pictou, Nova Scotia

Subject:                      Summary Conviction Appeal from conviction of the offence of assault contrary to section 266 of the Criminal Code of Canada.

Summary:                  Appellant police officer appealed conviction on grounds that the trial judge erred in finding no self-defence occurred in failing to apply and consider the provisions of the Police Act and section 25 of the Criminal Code of Canada.

Result:                        Appeal dismissed.  Although the trial judge erred in finding the appellant was not acting as a police officer at the time and was outside his jurisdiction, the trial judge’s finding of no self-defence was supported on the evidence.
