Summary: Appellant police officer appealed conviction on grounds that the trial judge erred in finding no self-defence occurred in failing to apply and consider the provisions of the Police Act and section 25 of the Criminal Code of Canada.
Result: Appeal dismissed. Although the trial judge erred in finding the appellant was not acting as a police officer at the time and was outside his jurisdiction, the trial judge’s finding of no self-defence was supported on the evidence.
