Subject:                                  Family Law

Issues:                         Parenting Plan

Violence and Substance Abuse

Protection Issue

Result:                                    A child protection proceeding evolved into a parenting dispute.                                          The children were placed in the sole custody of the father, with specified access to the mother.  The father’s plan of care was superior to the mother’s plan.  The father had been sober since 2005; the mother since 2012.  The father engaged in relapse prevention services.  Neither the mother, nor the mother’s fiancé did.  The mother and her fiancé continuously breached court orders and placed the children at risk.  The father was best able to meet the children’s physical, medical, social, recreational, and religious needs.  A detailed parenting plan was adopted given the unique circumstances facing the children.
