Summary:   The Plaintiff was referred to the Defendant by the Plaintiffs nurse practitioner concerning his prescription of amitriptyline.  The Defendant concluded the Plaintiff was suffering from Narcissistic Personality Disorder not massive depression and would not benefit from medication.  The Plaintiff sued the Defendant for medical malpractice. The Defendant moved for summary judgment.

 

 


 

Issue: Is this an appropriate case for summary judgment.

 

Result:        Summary Judgment granted.  The Plaintiff has no expert material or scientific evidence to support his claim.  There is no genuine issue of fact for trial.  If the Plaintiffs claim was permitted to go to trial, the Plaintiff would have no chance of success as he has no evidence the Defendant breached the requisite standard of care and no evidence the damages, if any, he suffered were caused or contributed to by any act or omission of the Defendant.
