Issue:                          Whether the circumstances of accident justified an interim payment where defendant raised issue of plaintiff’s credibility.

 

Summary:                   Plaintiff claimed to have suffered soft tissue injnury in a two vehicle accident where there was little damage to the vehicles.  Summary judgment entered by consent.

 

Result:                        Court determined that the evidence established with sufficient certainty that the physical disabilities of the plaintiff arose from the accident.  Ordered interim payment of $15,000.00
