Issues:            Whether Judge ought to have given parties notice he was considering rejection?  Whether recommended sentence is fit.  

 

Result:            Appeal allowed.  In light of R. v. MacIvor, the Judge ought to have given notice.  Also, the recommended sentence was fit.
