Summary:                      The Appellant launched two appeals pertaining to a recognizance obtained pursuant to Section 810 of the Criminal Code.  The individual Respondent, the Appellants estranged spouse, sought costs following the dismissal of the appeal.

 

Result:                           The Court concluded costs were available in the circumstances, and that the Appellant failed to establish he should be immune from such an award.
