Summary:                      Applicant sought an injunction to prevent Municipality from carrying out demolition of his barn, as dangerous pursuant to s. 346 of Municipal Government Act.  An ex parte injunction was granted on day Municipal tenders for demolition closed.  Applicant claimed Municipality did not follow procedural requirements of s. 346(3).

 

Result:                            On review hearing, R.J.R MacDonald analysis was applied and injunction vacated.
