2018 Claim No. SCT464157 IN THE SMALL CLAIMS COURT OF NOVA SCOTIA Citation: Patterson Law v. Mills, 2018 NSSM 97 BETWEEN: PATTERSON LAW Claimant - and-JENNIFER MILLS Defendant DECISION and ORDER [1] This matter came before the Court on October 2, 2018, at 6:00 pm. [2] Counsel. Paul Wadden, was present for the Claimant. [31 No one was present for the Defendant although Brendon Martin, barrister and solicitor, had previously appeared in Court for the Defendant on July 23, 2018, and had agreed to an adjourned date to October 2, 2018. As well, a notice of new hearing had been sent to Mr. Martin. Despite this, there was no email message or other form of communication from Mr. Martin advising that he would not be attending on behalf of his client on October 2nd. [4] I waited to 6:15 p.m. and then commenced to hear the representations on behalf of the Claimant. I also reviewed the materials filed on behalf of the Claimant. Based on the materials and representations I was satisfied that the amount in question was reasonable. Further, there was a clear agreement to pay interest on the overdue account. Accordingly, I allow the claim.
ORDER [5] It is hereby ordered that the Defendant pay to the Claimant as follows: Debt: $5,234.40 Interest: 2,198.45 Costs: 199.35 Total: $7,632.19 DAT EO at Halifax, Nova Scotia, this 22 day of October, 2018. ~~!~~-"'- / MicHm J. O'HARA ADJUDICATOR 2
