Summary:                   The Defendants had a mortgage with CIBC Mortgages Inc.  The Mortgage was not registered at the Registry of Deeds.  Subsequently, defendants executed a mortgage with another lender which was recorded.  The defendants have subsequently declared bankruptcy.

 

Issue:                          Should BIA stay be lifted?
